TERMS OF SERVICE

1. General Overview These terms and conditions govern the provision of aerial cinematography, FPV (First-Person View) operation, and bespoke drone services provided by Adrian Tomlin trading as Flightcraft Media ("Flightcraft Media", "we", "us", "our"). By engaging our services, the client ("you", "the production") agrees to these terms.

2. Safety & CAA Compliance All aerial operations are conducted strictly in accordance with UK Civil Aviation Authority (CAA) regulations.

  • Absolute Authority: The Pilot in Command (PIC) holds absolute and final authority over all flight operations. If the PIC determines that a requested shot or flight path compromises safety, breaches CAA regulations, or poses an unacceptable risk to crew, talent, or property, the flight will be grounded or altered. This decision is not subject to negotiation on set.

  • Permissions & Clearances: While Flightcraft Media will manage standard flight risk assessments, the client is responsible for securing any necessary location releases, land-owner permissions, or specific broadcast clearances prior to the shoot date.

3. Weather & Operational Delays Aerial cinematography is inherently weather-dependent.

  • Flightcraft Media continuously monitors aviation weather forecasts prior to deployment.

  • If a shoot must be postponed or cancelled on the day due to adverse weather conditions (including but not limited to high winds, rain, or low visibility) that exceed the safe operating limits of the aircraft, the client will be liable for a pre-agreed day rate or cancellation fee to cover the time and deployment of the aerial unit.

4. Booking, Payment & Cancellations

  • Confirmation: A shoot is only considered confirmed once a written brief is agreed upon and, if applicable, a deposit is received.

  • Cancellations: In the event the client cancels a confirmed booking within 48 hours of the scheduled call time (for reasons other than weather), Flightcraft Media reserves the right to charge up to 100% of the agreed day rate and any incurred travel/equipment expenses.

  • Payment Terms: Invoices are strictly payable within 30 days of the invoice date unless otherwise agreed in writing with the production company.

5. Deliverables & Copyright

  • Ownership: Flightcraft Media retains the copyright to all raw footage and photography until the final invoice is paid in full. Upon full payment, a license for usage will be granted to the client as per the agreed project brief.

  • Promotional Usage: Unless a Non-Disclosure Agreement (NDA) is signed prior to the shoot, Flightcraft Media reserves the right to use selected, non-sensitive, broadcast-cleared clips for our own promotional showreels and portfolio after the project has been publicly released.

6. Insurance & Liability Flightcraft Media carries comprehensive Assimilated Regulation (EC) 785/2004 drone operator Public Liability Insurance. We accept no liability for any delays, loss of production time, or consequential losses incurred by the client due to weather, mechanical failure, or necessary safety stand-downs.

7. Governing Law These Terms of Service shall be governed by and construed in accordance with the laws of England and Wales.
